Subcontractors still owed money for work they completed on the new Clay County Health Department Building need to hire an attorney and get a proper claim into the hands of the bonding company as soon as possible.
That was the advice from Clay County attorney Chester Jones, who drove from Franklin to Hayesville to attend a special Thursday evening session of the Clay County Commission to discuss slow payments to subcontractors who worked on the project.
“Payment bond claims will be lost if they are not made in a timely manner,” Jones said. “They should have been made yesterday. The subs can’t be paid if they haven’t made a claim. The bonding company won’t consider a claim unless the subs have filed it. If I personally was owed money on this job, I would be making a bond claim.”
This payment issue surfaced at the last county commission meeting when Jake Davies of Davies Contracting in Hayesville made a plea for the county to intercede because, he said, subcontractors on the project are still owed almost $80,000 for work on the Health Department building.
The county has paid for the work, but Blue Ridge Enterprises, Inc. of Mt. Airy, contractor on the project, has not passed the payments along to all the subcontractors...
